How to Resolve a Labour Dispute in Dubai

The steps, in order

   Raise the complaint with MOHRE

   Begin by taking your grievance to MOHRE, which handles labour complaints and attempts a friendly settlement between worker and employer. If you want guidance first, you can reach MOHRE's 'Labour Claims and Advisory Call Centre' on the toll-free number 80084 for help with any labour-related grievance or legal matter.

   Understand the settlement window

   If a friendly settlement is not possible within 14 days from the date of application, the ministry shall refer the dispute to the competent court and provide a memorandum including a summary of the dispute, the arguments of both parties and the ministry's recommendation.

   When the claim must go to the judiciary

   If the disputed claim is more than AED 50,000 and the parties cannot agree on a resolution, MOHRE must refer the case to the judiciary. From there the court takes over the dispute.

   Check whether court fees apply to you

   Article 55 of the UAE Labour Law exempts workers or their heirs from paying judicial fees at all stages of litigation and execution, for claims less than AED 100,000. If your claim falls under that amount, you should not be charged those fees.

   If you keep working during the case

   You have the right to claim two months' wages if you continue to work for the employer while the referred labour dispute is in the court, so staying on the job does not mean giving up that entitlement.

   If the complaint stops your work

   In cases where the labour complaint leads to the worker's cessation of work, the work permit will be cancelled after 6 months from the date of referring the complaint to the labour court. Plan your status and next steps with that in mind.

   Know when penalties apply to the employer

   Penalties or administrative actions may be taken against the establishment or the employer only after settling or resolving the dispute as per the laws — not while the matter is still open.
