In 2008, many buyers lost money on Dubai developments that were never completed. In response, Dubai introduced strict escrow legislation — now your funds physically cannot reach the developer until real, verified progress has been made on-site.
How RERA Escrow works
Before launching sales, every developer must open a dedicated escrow account at one of 11 RERA-accredited banks (Emirates NBD, ADCB, Mashreq, ENBD, FAB, and others). The account is tied exclusively to a specific project and its DLD registration number.

What to check before buying off-plan
- Project is RERA-registered: the registration number appears in all advertising materials and in the SPA.
- Escrow account is open: you can verify it on rera.gov.ae or through the Dubai REST app.
- The escrow bank agent is specified in the contract (bank name and account number)

Three risk areas that escrow does not cover
Escrow protects your money — but not every aspect of the transaction:
- Construction quality:RERA does not regulate finishes or materials. What's shown in the brochure versus what you actually receive at handover is a separate matter entirely.
- Handover dates:Delays of 1–2 years have become the norm. The escrow mechanism doesn't penalize developers for them. Your real protection is a delay penalty clause in the SPA — negotiate it before signing.
- Project update:The developer may change floor plans or amenities within the limits permitted by RERA. Read the SPA carefully.

- An escrow account is a dedicated bank account opened by the developer at a RERA-accredited bank for a specific project. All buyer payments for that project are directed exclusively to this account. The escrow agent bank oversees fund disbursements to the developer, releasing money only after a RERA inspector has confirmed the completion of a defined construction milestone.
- How to verify an escrow account before buying?
- On the RERA website (rera.gov.ae) or through the Dubai REST app, you can look up any project: enter the project name or registration number and you'll see the escrow account status, current construction progress (%), and the approved payment schedule. If the project isn't registered or the account shows as inactive — that's a red flag.
- What happens to the funds if the developer goes bankrupt?
- Funds held in escrow are protected — they cannot be seized to settle the developer's debts to third parties. If a project is suspended, RERA appoints a trustee who either brings in a new developer to complete the project or arranges refunds to buyers from the escrow account. This protection is guaranteed under Dubai Law No. 9/2009 on Escrow Accounts.
- Can payments be made directly to the developer, bypassing escrow?
- No. Any RERA-licensed developer is legally required to accept payments only into the registered escrow account. If you're asked to transfer funds to a personal account, a third-party company account, or in cash — that's a violation of the law and grounds to walk away from the deal immediately. All payment details can be verified through RERA.
- At what stage does the developer receive funds from escrow?
- Under Dubai law, a developer may withdraw no more than 5% from escrow at the initial stage (marketing and permits), followed by 30–20–20–15–10% tied to the completion of structural milestones: foundation, frame, facade, fit-out, and handover. The exact schedule is approved by RERA and specified in the SPA.
