Inheriting property in Dubai: how title passes to the heirs

Transferring a property to heirs in Dubai runs through a dedicated Dubai Land Department procedure, and it costs a flat AED 1,000 per property rather than a percentage. The gating document is an official letter from a court or the Awqaf addressed to DLD. Here are the documents, fees and timings from the service page.

Nobody enjoys thinking about it, but an owner of foreign property has to: what happens to a Dubai apartment after the owner dies, and how it passes to the heirs. There is a dedicated government procedure for it — Inheritance Title Transfer.

A boundary for this article, stated up front. We cover ONLY the transfer procedure: what documents DLD needs, what it costs, how long it takes. We do not cover who becomes an heir or in what shares, and we give no advice on wills — the service page does not address that, and filling succession law in with guesswork in an article written for people is not acceptable.

What the service does

DLD's wording: the service allows applying for registration of property ownership for heirs, transferring the property from the deceased to the heirs based on the legal inheritance certificate and the heirs' identification documents.

The key consequence: DLD does not determine who the heirs are. It executes what a competent authority has established.

The document without which nothing starts

The service page requires an official letter from Dubai Courts, other UAE courts, or the Awqaf, addressed to the Dubai Land Department, requesting the transfer of ownership to the heirs.

That is the critical path. Until that letter exists, the other documents do not matter.

The full list from the page:

  • a legal notification of inheritance;
  • Emirates ID copies of all heirs — citizens and residents;
  • valid passport copies for non-resident heirs;
  • a no-objection letter from the mortgaging entity or the developer;
  • the official letter from a court or the Awqaf addressed to DLD.

Read the mortgagee point twice: if the property is mortgaged, the bank is part of the procedure.

Two features worth noticing:

  1. The fee is flat, not a percentage. AED 1,000 per property, regardless of its value. That differs fundamentally from a sale (2% + 2%) and from a gift (0.125% with an AED 2,000 minimum).
  2. The service partner fee here is AED 130 + VAT, whereas neighbouring DLD services charge AED 2,000–4,000 + VAT. Numbers do not transfer between services — these are different schedules.

Service delivery is 8 working hours. That covers registration at DLD; obtaining the court letter lives on its own, far longer clock.

The service is available to UAE citizens, residents and tourists — the heirs do not all need resident status.

Worth doing in advance

  1. Know where the Title Deed is and the property's status (is it mortgaged).
  2. Know which authority issues the inheritance certificate in your case.
  3. Check that registry data is current — Title Deed verification.
  4. Account for the bank if the property is mortgaged.
  5. Do not read "8 hours" as the duration of the whole process — it is the duration of one step.
