How to buy an apartment in Dubai: what the rules actually say

If you live in Dubai on a residence visa, or you're abroad and looking at the market from a distance, the first questions are usually the same: can I own it outright, what exactly am I buying, and who issues the paperwork. The Official UAE Government Portal (u.ae) answers those directly, and the answers matter more than any brochure. Below is the procedure as the portal describes it — with an honest note wherever the portal doesn't publish a number, because guessing at fees or timelines helps nobody.

    Confirm the apartment is in a freehold area

    Buying property in Dubai In Dubai, foreign ownership is permitted in areas designated as freehold. This is the gate everything else depends on: if the building isn't in a designated freehold area, the ownership route you're picturing may not be available to you. Establish this before you view anything, not after you've made an offer.

    Work out which right you are buying

    The portal is precise here. Foreigners (who don’t live in the UAE) and expatriate residents may acquire freehold ownership rights over property without restriction, usufruct rights, or leasehold rights for up to 99 years. The same page also states the period as up to 99 years. Freehold, usufruct and leasehold are three different things, and the term sheet you sign should say plainly which one it is.

    Understand usufruct if that's what's on offer

    Usufruct Expatriates can own residential units for 99 years. It is a right to use the property for that period rather than freehold ownership without restriction — worth reading carefully if a seller or developer presents it alongside freehold stock as though the two were interchangeable.

    Understand musataha if that's what's on offer

    Musataha Expatriates can own residential units for a period of 50 years, renewable by the agreement of the parties for a similar period. The renewal is by agreement of the parties — meaning it is not automatic, and the terms of that renewal belong in the contract rather than in a verbal assurance.

    Check what you can do with the property afterwards

    Article 4 stipulates that the holders of a 'usufruct' or 'musataha' for more than 10 years have the right, without the consent of the landlord to dispose of the property, including the right of mortgage. If you intend to mortgage or resell, this is the clause to hold your contract against.

    Get the title deed from the right authority

    The title deeds are issued by the Land Department in the emirate. A deed is the document that records your ownership — no other paper from an agent, developer or broker substitutes for it. Make sure you know when it will be issued and in whose name.
