You can buy a property that still carries the seller's mortgage — but the order of steps is the reverse of what you would expect: the sale is registered first, the bank receives a cheque for the debt, and only after the release letter does the procedure close. We read the Land Department's service card: six steps, three manager's cheques and the full bill of fees.

The most common fear on the secondary market sounds like this: "the seller still has a mortgage on it — what if I pay and the charge is never released?" The Land Department has a dedicated service for exactly this case, and it answers not with a promise but with an order of steps.
The order is the reverse of what you expect
Verbatim from the description: the service allows applying to register a mortgaged property in order to pay what is due to the bank and so secure the parties' rights, "provided that the sale procedure to be completed after submitting a mortgage release letter from the bank" — the sale is completed after the bank's release letter is submitted.
Registration therefore begins before the charge is released and finishes after it. Between those points sit the steps named on the card.
Six steps, as written
- The parties attend a Real Estate Trustee registration centre.
- The registrar accepts the documents and checks that none are missing.
- The registrar enters the transaction details into the system.
- The parties pay the fees and receive a receipt by email.
- The Department's auditor reviews the transaction; afterwards a link to the registration certificate is sent to both parties, and the seller is handed the bank's indebtedness cheque — with which they obtain the mortgage release certificate.
- Once the release letter is submitted, registration completes: the release, the sale, and the new mortgage if there is one.
Step five is the answer to the original fear: the cheque covering the debt goes not into the seller's own account but towards the bank, and solely so that the release letter comes back.
Three manager's cheques — a requirement, not a custom
Among the documents required from individuals: three manager's cheques, distributed as follows:
- a cheque in the name of the bank or developer — for the amount of the debt;
- a cheque in the seller's name — for the remaining amount, if any;
- a cheque in the name of the Department — with fees of 4%.
Note that here the Department states its fee as a single 4% line, whereas on the ordinary sale card it is split into 2% from the seller and 2% from the purchaser — a bill we went through in the piece on the 4% and the full transfer bill.

One line of the card we do not reproduce, because we read it ambiguously. The fee list contains "AED 10 innovation fee: AED 525": this may be a separate AED 525 charge, or a typo carried over from the neighbouring line. We will not think on the Department's behalf — if that amount matters to you, confirm it at the registration centre.
The card states the processing time as 15–20 minutes, through Real Estate Registration Trustees centres.
What follows for the buyer
The charge is released by step six, not by assurance. Until the bank's letter is submitted, the procedure is not complete. That is the built-in protection: the money for the debt travels by cheque towards the bank, not on trust.
Count the mortgage fee separately. If you are financing the same purchase, 0.25% of the loan is added — a line absent from a cash deal. The loan ceilings themselves we covered in the piece on CBUAE LTV limits, and the mortgage statute in the piece on Law 14/2008.
What we do not claim here
- The meaning of the "AED 10 innovation fee: AED 525" line. It reads ambiguously; we do not reproduce it.
- That the 4% is borne by the buyer. The card requires a cheque in the Department's name with fees of 4%; who provides it is settled between the parties.
- Bank timing. The card states the Department's service time, not how long a bank takes to issue a release letter.
- VAT on partner fees. This card does not address it.
